Finch Computing, LLC dba Finch AI (“Finch”), is committed to protecting the privacy of its customers and any and all data that may be derived from the use of its websites and applications (hereinafter, “products”) as described in this Privacy Policy.  This Privacy Policy does not apply to any other products or services, or to information collected in any other way (whether offline or online), by Finch and its affiliates, unless expressly indicated by Finch (such as by including a link to this Privacy Policy on other Finch websites). 1. Commitment to Maintaining Privacy

Finch is committed to protecting the personal information that our customers choose to share with us.  Finch values and respects their privacy.  Finch understands the importance of maintaining the trust and confidence of our customers, and to that end, will use reasonable measures to ensure that any personal information submitted or collected remains private and is used only as set out in this Privacy Policy and in accordance with applicable law.

2. Information Collection and Storage

When a customer or user account is created with Finch, we may ask for personal information that may include, but is not limited to names and email addresses.  This information is held on our servers and will only be shared with corporate affiliates and personnel with a need to know.  This information is used to provide user-requested services or products and to communicate with our customers and authorized users.

When our products are used, we receive information from web browsers or other user interfaces and store that information on our servers, including IP addresses, the time and date of access, subscription status, transaction information, the latitude and longitude of any location-based searches, search text and parameters, files/listings accessed, version of the product being used, cookie information, URLs and source information or the documents and web pages requested and content of the documents and web pages requested.  Third-party web content may be requested through Finch services but is supplied by third parties. The requests for web content may require a direct connection to third-party systems or may also travel through proxies. Proxies may include Finch and/or third-party proxy servers. Proxy servers might use and store information about those requests. Any third-party server or software is outside the control of Finch, and Finch does not accept any responsibility for the use or misuse of such information by any such third party.

We may also utilize certain standard web measurement and tracking technologies such as “cookies,” web server logs, or other statistics programs to collect usage information and track and record how our products are used. Usage information helps us measure the success of our products and their features or pages and to improve the customer experience.  Web browsers may have an option that allows a user to accept cookies, reject cookies, or receive notifications when a cookie is sent, however the use of such restrictive browser settings may limit the use of our products. In addition, we may utilize beaconing technologies (also known as “action tags” or “one pixel .gif files”) provided by Finch and/or our publishing partners to measure the effectiveness of, and otherwise manage distribution of, content offerings. These beacons enable our servers to recognize the content accessed when our products are used and to determine the origination site of users utilizing our products. We do not use spyware, adware or any other similarly intrusive software.

To assist us with the uses described in this Privacy Policy, information collected about the usage of our products may be combined with personal or other information from other online or offline sources. In order to prevent the combination of non-personal information that has been collected through cookies about the use of our websites with personal or other user information, please delete and disable cookies for each browser, and on each computer that is employed to utilize our products.

Most browsers are set to accept cookies by default; however, browsers can be set to disable cookies, or to provide alerts when cookies are being sent. Likewise, most mobile devices allow the disabling of the ability for geo-location information to be collected from that mobile device. The “Help” function on most browsers and mobile devices contains instructions on how to set browsers to provide such notifications accepting cookies, or how to disable cookies entirely, or to disable the collection of geo-location data. These settings typically must be set individually on each browser, and on each device used to surf the Web.  Please note, however, that the disabling of cookies or refusal to accept a request to place a cookie may cause some parts of our products or the login page for our websites to not function properly.

3. Purpose of Data Collection

We use information in order to provide services to our customers and to analyze, manage and improve our products so that we may continually strive to provide them with the best possible solutions and customer experience. In compliance with applicable laws, it is our policy to require only the personal information necessary to enable us to complete transactions requested by our customers.  We do not condition participation in any specific activity within our products, including any transaction, on the disclosure of more personal information than is reasonably necessary to complete such activity and/or transaction. Information such as traffic patterns and the number of page visits helps us to further develop and improve our products’ layout to better meet our customers’ needs. We also use information such as user names and e-mail addresses to contact our customers, to respond to inquiries, and to send information. Finally, we use collected information to help us diagnose problems with our servers or other technical issues relating to the performance of our products.  Any personally identifiable information that is voluntarily provided (e.g., name, email address, personal photographs, etc.) on a bulletin board, chat room or on any other community forum offered via our products, may be collected and used by others and may result in unsolicited messages from other parties. We have no control over this usage of personally identifiable information and, as such, do not accept any responsibility for its use or misuse.

4. Disclosure

We may disclose the information we collect from and about our customers and users, including usage information: (a) when we have reason to believe that such disclosure is necessary to identify, contact or bring legal action against someone who may be causing injury to, or interference with (either intentionally or unintentionally), our rights or property, customers or other users of our products, or anyone else who could be harmed by such activities, or is appropriate or necessary to enforce our terms of use, take precautions against liability, investigate and defend against any third-party claims or allegations, and/or protect the security or integrity of our products; (b) to respond to judicial process and provide information to law enforcement agencies in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law, or in the good-faith belief that such action is necessary to comply with state and federal laws; or (c) otherwise with the consent of our customers and/or users. In the event that Finch sells or buys other businesses or entities, personal information may be transferred as part of such a transaction.  Also, in the unlikely event of our bankruptcy, insolvency, reorganization, receivership, assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, personal information may be transferred in connection with those proceedings.

We may use usage information, and share it with certain third parties, to identify and develop products and services that may be of interest to our customers and certain demographic groups, but only on an anonymous and aggregate basis.  Subject to the foregoing, we do not sell personal information to third parties, and have no intention of doing so in the future.

5. Protections

Finch takes reasonable and prudent precautions to ensure that personal information is protected from unauthorized access, use, modification or disclosure. These measures include password protection, firewalls, and secure servers. To protect the confidentiality of personal information, passwords MUST be kept confidential and not be disclosed to any other person.

No data transmission over the Internet or any wireless network can be guaranteed to be secure. As a result, while we try to protect personal information, we cannot ensure or guarantee the security of any information transmitted to us, and all such transmittals by any customer or user is done at their own risk.

We take commercially reasonable precautions and have implemented commercially reasonable technical measures intended to protect against the risks of unauthorized access to, erroneous disclosure of, and unlawful interception of personal information submitted in connection with the use of our products. However, email transmissions and/or other communications containing personal information may be unlawfully intercepted or accessed by third parties and/or our products may be subject to hostile network attacks or administrative errors. We cannot and do not guarantee the security of any information transmitted over the Internet. Once we receive personal information, we take steps that we believe are commercially reasonable to limit access to such personal information to only those we determine need access to the personal information to provide the requested products, services, offers or opportunities that we believe may be of interest to our customers and other users. However, even after we receive personal information, we cannot guarantee that such personal information may not be accessed, disclosed, altered, or destroyed as a result of a breach of our commercially reasonable efforts or as a result of any other event beyond our reasonable control. Accordingly, we cannot and do not guarantee that any personal information is completely secure and safe from such risks. For the avoidance of doubt, we expressly disclaim any representation or warranty, whether express or implied, with respect to ensuring, guaranteeing or otherwise offering any definitive promise of security in connection with any personal information or usage information.
